These Terms and Conditions set out the basis on which Waste Disposal Balham provides waste collection and related services to residential and commercial customers. By making a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order or arranging any collection.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Service means any waste collection, removal, recycling, disposal, or related service provided by Waste Disposal Balham.
1.2 Customer, you, or your means the person, company, or organisation that books or receives the Service.
1.3 We, us, or our means Waste Disposal Balham, the service provider.
1.4 Waste means any items, materials, or refuse presented for collection, including general household waste, commercial waste, garden waste, and bulky items, but excluding prohibited or hazardous materials as set out in these Terms and Conditions.
1.5 Service Area means the locations within which we offer waste collection and related services, including Balham and surrounding areas, as communicated by us from time to time.
2.1 We provide waste collection and disposal services within the Service Area, subject to availability, access, and compliance with applicable waste regulations.
2.2 Our services may include one-off waste clearances, regular scheduled collections, bulky waste removal, garden waste clearance, and other related services as agreed at the time of booking.
2.3 We reserve the right to refuse to collect any Waste that does not comply with these Terms and Conditions, is unsafe to handle, or is prohibited by law or regulatory guidance.
3.1 You may request a booking by contacting us by telephone or other communication method we make available. A booking is only accepted once we confirm the details of the Service and provide a confirmation of the appointment or scheduled collection.
3.2 When making a booking, you must provide accurate information regarding:
a) The type and approximate quantity or volume of Waste.
b) The address for collection within the Service Area.
c) Access restrictions, parking arrangements, and any relevant property details.
d) Any items that may be hazardous or require special handling.
3.3 Our quotation is based on the information you provide at the time of booking. If, on arrival, the Waste is materially different in type, volume, or weight, or access is significantly more difficult than described, we may adjust the price, amend the Service, or decline to carry out the collection.
3.4 Bookings are subject to our availability. We will use reasonable efforts to attend at the agreed time and date, but all times and dates are estimates only and not guaranteed. We will not be liable for minor delays due to traffic, access issues, or events outside our reasonable control.
4.1 You are responsible for ensuring that we have safe and reasonable access to the collection point at the agreed time.
4.2 You must provide suitable instructions regarding entry and any security arrangements. Where necessary, you must ensure that someone is present at the collection address to provide access and confirm the Waste to be removed.
4.3 You must ensure that the Waste is ready for collection, is not contaminated with prohibited materials, and is located in a safe position where it can be accessed and removed without risk of injury or damage.
4.4 If we are unable to gain access, or if the Waste cannot be collected due to your failure to comply with these obligations, we may charge a call-out fee or treat the booking as a cancellation in accordance with these Terms and Conditions.
5.1 Charges for our services will be confirmed at the time of booking, based on the type, volume, and weight of Waste, the nature of the property, access considerations, and any additional services requested.
5.2 We may require full or partial payment in advance, or payment upon completion of the Service, as communicated at the time of booking.
5.3 Payment may be made by cash, card, bank transfer, or any other method we accept. You are responsible for ensuring that payment is made in full and on time.
5.4 If the actual volume or nature of Waste on the day of collection results in a higher charge than originally quoted, we will inform you of any additional cost before proceeding, where reasonably practicable. If you do not agree to the revised charge, we may decline to carry out the Service and may charge a reasonable call-out fee.
5.5 All prices are inclusive of disposal fees and, where applicable, any taxes that may be levied on the Service unless explicitly stated otherwise.
6.1 You may cancel or amend your booking by contacting us directly. Cancellations and amendments are only valid once acknowledged by us.
6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged, unless otherwise stated at the time of booking.
6.3 If you cancel less than 24 hours before the scheduled collection time, we reserve the right to charge a cancellation fee to cover our reasonable costs, including any allocation of vehicles, staff, and disposal arrangements.
6.4 If we are unable to perform the Service on the scheduled date due to events beyond our reasonable control, such as severe weather, vehicle breakdown, or access restrictions not caused by us, we will offer to reschedule. We will not be liable for any losses arising from such delays or rearrangements.
6.5 We may cancel the Service at any time if you are in breach of these Terms and Conditions, if providing the Service would be unsafe or unlawful, or if the waste presented is fundamentally different from that described at the time of booking.
7.1 We will collect and dispose of general household waste, commercial waste, recyclable materials, garden waste, and bulky items, subject to applicable regulations and facility availability.
7.2 You must not present any of the following prohibited items for collection unless explicitly agreed by us in writing and in accordance with applicable regulations:
a) Hazardous waste such as chemicals, solvents, paints, oils, asbestos, or clinical waste.
b) Gas cylinders, pressurised containers, explosives, or ammunition.
c) Items containing persistent or dangerous pollutants.
d) Any waste classified as hazardous or requiring specialist handling or licensing under UK law.
7.3 If we discover prohibited or hazardous items within the Waste at the point of collection or after removal, we may charge you for any additional costs incurred in handling, transporting, and disposing of such materials safely and lawfully.
7.4 You warrant that all Waste presented for collection complies with relevant UK waste regulations and does not pose a health or safety risk to our staff, contractors, or the public.
8.1 We operate in accordance with applicable UK waste management legislation, including any duties relating to licensing, transfer notes, and the lawful disposal of controlled waste.
8.2 We will transport and dispose of Waste only at appropriately licensed facilities or in line with relevant regulatory requirements. We will use reasonable endeavours to recycle or recover materials where suitable options are available.
8.3 You acknowledge your duty of care in relation to Waste and agree to provide accurate information so that waste can be handled, transported, and disposed of correctly.
8.4 On request, and where applicable, we may issue waste transfer documentation to confirm receipt and transfer of certain types of commercial or controlled waste, subject to any administrative fees that may apply.
9.1 We will exercise reasonable care and skill in providing the Service. However, to the fullest extent permitted by law, we exclude all conditions, warranties, and representations that are not expressly set out in these Terms and Conditions.
9.2 We will not be liable for any indirect or consequential loss, loss of profit, business interruption, loss of data, or loss of opportunity arising out of or in connection with the Service.
9.3 Our total liability to you in respect of any claim arising under or in connection with the Service (whether in contract, tort, negligence, or otherwise) shall be limited to the total price paid or payable by you for the relevant Service that gave rise to the claim.
9.4 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.
9.5 You are responsible for securing or removing any items that you do not wish to be taken as Waste. We will not be responsible for the removal of items mistakenly left with the Waste unless directly and solely caused by our negligence and clearly identified prior to collection.
9.6 We will take reasonable care to avoid damage to property during collection. However, you must notify us of any fragile surfaces, underground services, or particular site risks. We will not be liable for damage arising from insufficient or inaccurate information regarding site conditions or from pre-existing defects.
10.1 You warrant that you either own the Waste or are authorised by the owner to arrange its collection and disposal.
10.2 You agree to indemnify us against all claims, costs, losses, and expenses arising from your breach of these Terms and Conditions, including the presentation of prohibited or hazardous materials or failure to comply with relevant waste regulations.
11.1 We may collect and process personal data relating to you for the purposes of administering bookings, delivering the Service, processing payments, and handling enquiries or complaints.
11.2 We will handle personal data in accordance with applicable data protection laws. We will not sell your personal data to third parties.
11.3 We may contact you using the details you provide in relation to your booking, including to confirm or amend appointments, request additional information, or seek feedback on our services.
12.1 If you are not satisfied with the Service, you should contact us as soon as reasonably possible, providing details of the issue and any supporting information.
12.2 We will investigate complaints in a fair and timely manner and aim to reach a resolution where appropriate, which may include re-attending the site or offering a partial refund, depending on the circumstances.
12.3 Making a complaint does not entitle you to withhold payment for services already properly provided, except where we agree otherwise in writing.
13.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or operational needs.
13.2 The version of the Terms and Conditions in force at the time of your booking will apply to that booking, unless a change is required by law or regulatory authority, in which case the updated terms may apply to existing bookings as well.
14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.
15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
15.2 No failure or delay by us in exercising any right or remedy shall constitute a waiver of that or any other right or remedy.
15.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations at any time, provided this does not materially reduce the level of service you receive.
15.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the Service and supersede any previous understandings, communications, or agreements, whether oral or written.
